Nintendo can remotely destroy modified 3DS handhelds
Wii love Mario, but we're not too thrilled about Nintendo's new Terms of Service (TOS) for its 3DS handheld. In the TOS, Nintendo is threatening to remotely destroy any 3DS handhelds that are found to be modified or using unauthorized devices. This is what Nintendo has in their 3DS Terms of Service:
"any existing or future unauthorized technical modification of the hardware or software of your Nintendo 3DS System, or the use of an unauthorized device in connection with your system, will render the system permanently unplayable."
What does that mean? The "unauthorized device" they're referring to are flashcards like the R4 3DS, Acekard 2i 3DS or SuperCard DSTWO for 3DS. If they detect these flashcards running on YOUR property, they'll remotely send a signal to turn your shiny new 3DS into a worthless brick. Is this fair? Not at all! The people over at Defective By Design (DBD) are running a campaign and petition to get Nintendo to change their TOS for the 3DS. They're currently taking donations and for every donation they receive, they'll send a real brick to the President and COO of Nintendo America, Reggie Fils-Aime.

UPDATE: It seems that Nintendo will also claims a perpetual, worldwide license to the photos and videos you take with YOUR 3DS camera!
By accepting this Agreement or using a Nintendo 3DS System or the Nintendo 3DS Service, you also grant to Nintendo a worldwide, royalty-free, irrevocable, perpetual, non-exclusive and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display your User Content in whole or in part and to incorporate your User Content in other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.
So they want to own every image and video that you take on your 3DS! Nintendo, you so crazy!
